Article 8 Withdrawal of Consent for the Collection, Use, and Provision of Personal Information

You can withdraw your consent to the collection, use, and provision of your personal information at any time. You can withdraw your consent by clicking "Withdraw Membership (Withdraw Consent)" on "My Page" or by contacting the personal information manager via email. The necessary measures will be taken to delete your personal information immediately.
This site will ensure that withdrawal of consent for the collection of personal information can be done through the same method and procedure as when the information was collected.

Article 9 Retention and Use Period of Personal Information

In principle, once the purpose of collecting and using personal information has been achieved, the information is promptly destroyed. However, the following information will be retained for the specified period for the following reasons:
1. Retention items: Membership registration information (login ID, name, nickname)
2. Retention reason: To prevent other members from re-registering and using the same user ID after membership withdrawal
3. Retention period: Permanent
Additionally, if required by relevant laws such as commercial law, the company will retain transaction and membership information for a certain period as specified by the laws:
1. Retention items: Records of contracts or subscription withdrawals, records of payments and supply of goods, records of complaints or dispute resolution
2. Retention reason: According to Article 6 of the Act on the Consumer Protection in Electronic Commerce
3. Retention period: Records of contracts or subscription withdrawals (5 years), payment and supply of goods records (5 years), complaint or dispute resolution records (3 years)
If there is a need to continue retaining information beyond the retention period, the user's consent will be obtained.

Article 10 Destruction Procedures and Methods of Personal Information

In principle, this site promptly destroys personal information once the purpose of collecting and using it has been achieved. The destruction procedures and methods are as follows:
1. Destruction procedure: The information you entered for membership registration, etc., will be transferred to a separate database (or separate document for paper-based records) after the purpose has been achieved, and will be retained for a certain period in accordance with internal policies and relevant laws. Once the retention period is over, the personal information is destroyed. Personal information transferred to a separate database will not be used for purposes other than retention unless required by law.
2. Destruction method: Personal information stored in electronic file format is permanently deleted using a technical method that makes it unrecoverable.

Article 11: Protection of Children's Personal Information

This site collects personal information of children under the age of 14 only with the consent of their legal guardian.

Supplementary Provisions (Effective Date): These terms will be effective as of October 21, 2024.

Article 1: Purpose

The purpose of this agreement is to define the rights, obligations, and responsibilities between the site and users when using the internet-related services (hereinafter referred to as "services") provided by this site (hereinafter referred to as "KCY PARTNERS").

Article 2: Definitions

"KCY PARTNERS" refers to a virtual business place set up to provide users with goods or services (hereinafter referred to as "goods, etc.") through the use of computers and other information and communication equipment, and also refers to the business operator managing the cyber mall.
"User" refers to a person who accesses "KCY PARTNERS" and receives services in accordance with this agreement, including both members and non-members.
"Member" refers to a person who provides personal information to "KCY PARTNERS," registers as a member, and continuously receives information from "KCY PARTNERS," using its services.
"Non-member" refers to a person who uses the services provided by "KCY PARTNERS" without registering as a member.

Article 3: Display, Explanation, and Amendment of the Terms

"KCY PARTNERS" shall display the contents of this agreement, business name, representative’s name, business address (including the address for handling consumer complaints), phone number, fax number, email address, business registration number, e-commerce registration number, and personal information management officer on the main page of the site for users to easily access. However, the contents of the agreement can be made available to users through a connected screen.
Before agreeing to the terms, "KCY PARTNERS" must provide a separate screen or pop-up screen for users to check important details such as the right to withdraw an offer, shipping responsibilities, and refund conditions.
"KCY PARTNERS" may amend this agreement to the extent that it does not violate relevant laws such as the Consumer Protection Act in Electronic Commerce, the Act on Regulation of Terms, the Electronic Commerce Basic Act, the Electronic Signature Act, the Information and Communication Network Act, the Door-to-Door Sales Act, and the Consumer Protection Act.
If "KCY PARTNERS" amends this agreement, the amended terms will be posted on the main page of the site with the effective date and reasons for the changes at least seven days prior to the effective date. However, if the changes are unfavorable to the user, the notice period will be at least 30 days.
The amended terms will apply only to contracts made after the effective date, and existing contracts will follow the terms in effect at the time of the contract. However, if a user requests the application of the amended terms and "KCY PARTNERS" agrees, the amended terms may apply to existing contracts.
Any matters not provided in this agreement and the interpretation of this agreement shall follow relevant laws or common practices such as the Consumer Protection Act in Electronic Commerce, the Act on Regulation of Terms, and the Electronic Commerce Guidelines established by the Fair Trade Commission.

Article 4: Provision and Change of Services

"KCY PARTNERS" performs the following tasks:
1. Providing information on goods or services and concluding purchase contracts
2. Shipping of goods or services purchased under the concluded contracts
3. Other tasks defined by "KCY PARTNERS"
"KCY PARTNERS" may change the contents of goods or services to be provided in future contracts due to the unavailability of goods or technical changes. In this case, the revised goods or services and the date of provision will be notified on the site where the current goods or services are posted.
If the content of the service that "KCY PARTNERS" has agreed to provide to the user needs to be changed due to the unavailability of goods or technical reasons, "KCY PARTNERS" shall notify the user immediately using the address provided by the user.
"KCY PARTNERS" shall compensate users for any damages caused by changes mentioned in the previous paragraph. However, "KCY PARTNERS" is not liable if it can prove the absence of intent or negligence.

Article 5: Service Suspension

"KCY PARTNERS" may temporarily suspend services due to reasons such as maintenance, replacement, or failure of communication facilities like computers, or communication interruptions.
"KCY PARTNERS" shall compensate users or third parties for damages caused by service suspension as described in the previous paragraph. However, "KCY PARTNERS" is not liable if it can prove the absence of intent or negligence.
If "KCY PARTNERS" cannot continue providing services due to reasons such as business transition, abandonment of business, or integration with other companies, it shall notify the users according to Article 8 and compensate them according to the original terms of the site. If no compensation standards have been announced, "KCY PARTNERS" shall compensate users with cash or equivalent value in goods or credits.

Article 6: Membership Registration

Users can apply for membership by filling in their information in the registration form and indicating their agreement to this contract.
"KCY PARTNERS" will register users as members unless they meet any of the following conditions:
1. If the applicant has previously lost their membership status due to a violation of Article 7, Clause 3, except for those who have been reapproved for membership by "KCY PARTNERS" after three years have passed since their disqualification
2. If there is false, omitted, or incorrect information in the registration details
3. If registering the user as a member would significantly interfere with the technology or operations of "KCY PARTNERS"
The membership contract takes effect when "KCY PARTNERS" accepts the application and the notification reaches the user.
Members must notify "KCY PARTNERS" of any changes in their registration details immediately via email or other methods.

Article 7: Membership Withdrawal and Disqualification

Members can request to withdraw from membership at any time, and "KCY PARTNERS" will process the request immediately.
"KCY PARTNERS" may limit or suspend membership if the member:
1. Provided false information during registration
2. Fails to pay for goods or services purchased through "KCY PARTNERS" or other financial obligations related to the use of the site
3. Interferes with other users' use of the site or engages in actions that threaten the order of electronic commerce
4. Engages in actions that violate the law or this agreement through the use of "KCY PARTNERS"
If the same violation occurs more than twice or remains unresolved for more than 30 days after membership restriction, "KCY PARTNERS" may revoke the member’s status.
If "KCY PARTNERS" disqualifies a member, the member’s registration will be canceled, and the user will be notified. Before the cancellation, the member will be given at least 30 days to explain themselves.

Article 8: Notices to Members

"KCY PARTNERS" may send notices to members via the email address provided during registration.
For general notifications to unspecified members, "KCY PARTNERS" may substitute individual notifications by posting on the site’s bulletin board for at least one week. However, individual notifications will be sent for matters that significantly impact the member’s transactions.

Article 9: Purchase Application

The "KCY PARTNERS" user applies for a purchase on "KCY PARTNERS" through the following or similar methods, and "KCY PARTNERS" must provide the following details in an easy-to-understand manner. However, for members, items 2 to 4 may be excluded.
1. Search and selection of goods, etc.
2. Entering name, address, phone number, email address (or mobile phone number), etc.
3. Confirmation of terms and conditions, services where the right of withdrawal is restricted, costs related to shipping and installation fees, etc.
4. Indication of agreement to the terms, and confirmation or refusal of the matters in item 3 (e.g., mouse click)
5. Application for purchase of goods, etc., and consent to confirmation of "KCY PARTNERS"
6. Selection of payment method

Article 10: Formation of Contract

"KCY PARTNERS" may not accept the purchase application if it falls under any of the following items. However, if a contract is made with a minor, they must notify the minor or their legal representative that the contract can be canceled if there is no consent from the legal representative.
1. In cases where the application contains false information, omissions, or errors
2. When a minor attempts to purchase goods prohibited under the Youth Protection Act, such as cigarettes or alcohol
3. When the technical acceptance of the purchase application is deemed significantly difficult by "KCY PARTNERS"
The contract is considered formed when the user's receipt confirmation notice, as outlined in Article 12(1), reaches the user.
The expression of acceptance from "KCY PARTNERS" must include confirmation of the purchase application, the availability of goods for sale, and information about the correction or cancellation of the purchase application.

Article 11: Payment Methods

Payment methods for goods or services purchased on "KCY PARTNERS" can be made through the following available methods. However, "KCY PARTNERS" cannot impose any additional fees on the payment method chosen by the user.
1. Various bank transfers, such as phone banking, internet banking, and mail banking
2. Various card payments such as prepaid cards, debit cards, and credit cards
3. Online direct deposit
4. Payment using electronic money
5. Payment on receipt
6. Payment using points provided by "KCY PARTNERS"
7. Payment using vouchers contracted with or recognized by "KCY PARTNERS"
8. Other electronic payment methods

Article 12: Receipt Confirmation Notification, Purchase Application Change, and Cancellation

"KCY PARTNERS" will notify the user of the receipt confirmation when a purchase application is made.
Upon receiving the receipt confirmation notice, the user may immediately request a change or cancellation of the purchase application if there is a discrepancy in the intent. If the user requests a change or cancellation before shipment, "KCY PARTNERS" must promptly comply with the request. However, if payment has already been made, the regulations regarding withdrawal of applications in Article 15 apply.

Article 13: Supply of Goods

Unless there is a separate agreement on the supply timing of goods, "KCY PARTNERS" shall take the necessary steps such as order processing, packaging, and other actions to ensure delivery of the goods within 7 days from the day the user makes the purchase. However, if "KCY PARTNERS" has already received all or part of the payment, the necessary steps must be taken within 2 business days from the receipt of payment. "KCY PARTNERS" must provide appropriate measures to allow users to check the supply process and progress of goods.
"KCY PARTNERS" must specify the delivery method, who is responsible for the shipping cost, and the delivery period for the purchased goods. If "KCY PARTNERS" exceeds the agreed delivery period, it is liable to compensate the user for damages unless "KCY PARTNERS" can prove that it was not at fault.

Article 14: Refunds

If "KCY PARTNERS" is unable to deliver or provide the goods due to reasons such as out of stock, they must notify the user immediately and refund the payment within 2 business days from the date of notification.

Article 15 Withdrawal of Subscription, etc.

Users who have entered into a contract for the purchase of goods with "KCY PARTNERS" may withdraw their subscription within 7 days from the date of receiving the notice of confirmation.
If the user has received the goods, they cannot return or exchange them in the following cases:
1. If the goods are lost or damaged due to the user’s fault (however, if the packaging is damaged to check the contents of the goods, the withdrawal of the subscription can be made).
2. If the value of the goods has significantly decreased due to the user's use or partial consumption.
3. If the value of the goods has significantly decreased to the extent that resale is difficult due to the passage of time.
4. If the packaging of the original goods that can be replicated with goods of the same performance has been damaged.
In cases specified in items 2 to 4 of paragraph 2, if "KCY PARTNERS" did not indicate in a place easy for consumers to recognize that the withdrawal of subscription is restricted or did not take measures such as providing sample products, the user's right to withdraw the subscription will not be restricted.
Notwithstanding the provisions of paragraphs 1 and 2, if the contents of the goods differ from the description or advertisement, or if the contract is not fulfilled as agreed, the user can withdraw the subscription within 3 months from the date of receiving the goods or within 30 days from the date the user became aware or could have become aware of such facts.

Article 16 Effects of Withdrawal of Subscription, etc.

"KCY PARTNERS" will refund the payment received for the goods within 3 business days after receiving the returned goods from the user. If "KCY PARTNERS" delays the refund to the user, it must pay delay interest calculated by multiplying the delay period by the interest rate prescribed by the Fair Trade Commission.
When refunding the payment, if the user paid the price of the goods with a credit card or electronic money, "KCY PARTNERS" will promptly request the provider of the payment method to stop or cancel the billing for the price of the goods.
In the case of withdrawal of subscription, the cost necessary for returning the supplied goods is to be borne by the user. "KCY PARTNERS" will not claim penalties or damages from the user due to the withdrawal of subscription. However, if the withdrawal is due to the fact that the contents of the goods differ from the description or advertisement, or the contract is not fulfilled as agreed, "KCY PARTNERS" will bear the cost necessary for the return of the goods.
If the user bears the shipping cost when receiving the goods, "KCY PARTNERS" will clearly indicate who bears the cost in case of withdrawal.

Article 17 Personal Information Protection

"KCY PARTNERS" will collect only the minimum information necessary for the performance of the purchase contract when collecting user information. The following are mandatory, while other information is optional:
1. Name
2. Address
3. Phone number
4. Desired ID (for members)
5. Password (for members)
6. Email address (or mobile phone number)
"KCY PARTNERS" must obtain the consent of the user when collecting personal information that can identify the user.
Provided personal information cannot be used for purposes other than the intended purpose or provided to third parties without the consent of the user, and all responsibility lies with "KCY PARTNERS". However, the following cases are exceptions:
1. When providing the minimum necessary user information (name, address, phone number) to the delivery company for delivery purposes.
2. When necessary for statistical compilation, academic research, or market research, provided in a form that does not identify a specific individual.
3. When necessary for the settlement of payment for goods transactions.
4. When necessary for identity verification to prevent theft.
5. In cases where it is unavoidable due to legal provisions or reasons required by law.
When "KCY PARTNERS" needs to obtain the user’s consent in accordance with items 2 and 3, it must clearly specify or notify the user of the identity of the personal information manager (affiliation, name and phone number, other contact information), the purpose of collecting and using the information, and matters related to the provision of information to third parties (the recipient, the purpose of provision, and the content of the information provided) as specified in Article 22, Paragraph 2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., and the user can withdraw this consent at any time.
The user can request to view and correct errors in their personal information held by "KCY PARTNERS" at any time, and "KCY PARTNERS" has an obligation to take necessary measures without delay. If the user requests correction of an error, "KCY PARTNERS" will not use the personal information until the error is corrected.
"KCY PARTNERS" will limit the number of administrators to the minimum necessary for the protection of personal information and is fully responsible for any damage to users due to the loss, theft, leakage, or alteration of personal information, including credit card and bank account information.
"KCY PARTNERS" or third parties who receive personal information from "KCY PARTNERS" must destroy the personal information without delay once the purpose of collection or provision is achieved.

Article 18 Obligations of "KCY PARTNERS"

"KCY PARTNERS" shall not engage in acts prohibited by laws and these terms and shall strive to provide goods and services continuously and stably in accordance with these terms.
"KCY PARTNERS" must have a security system in place to protect user personal information (including credit information) so that users can safely use internet services.
If "KCY PARTNERS" engages in unfair labeling or advertising practices under Article 3 of the Act on Fair Labeling and Advertising, resulting in damage to the user, it shall be liable for compensation.
"KCY PARTNERS" will not send unsolicited advertising emails for commercial purposes to users.

Article 19 Responsibilities Regarding Members' ID and Password

Except for the cases specified in Article 17, the responsibility for managing the ID and password lies with the member.
Members must not allow third parties to use their ID and password.
If a member realizes that their ID and password have been stolen or used by a third party, they must immediately notify "KCY PARTNERS" and follow the instructions provided by "KCY PARTNERS".

Article 20 Obligations of Users

Users must not engage in the following acts:
1. Registration of false information during application or modification
2. Theft of others' information
3. Modification of information posted on "KCY PARTNERS"
4. Transmission or posting of information other than that prescribed by "KCY PARTNERS" (such as computer programs)
5. Infringement of copyrights and other intellectual property rights of "KCY PARTNERS" or third parties
6. Acts that damage the reputation of "KCY PARTNERS" or interfere with its operations
7. Publicly posting or publishing obscene or violent messages, images, sounds, or other information contrary to public morals on the site

Article 21 Relationship Between "KCY PARTNERS" and Linked "KCY PARTNERS"

When a higher "KCY PARTNERS" and a lower "KCY PARTNERS" are linked in a hyperlinked manner (for example, hyperlinks may include text, images, and moving images), the former is called the connecting "KCY PARTNERS" (website), and the latter is called the linked "KCY PARTNERS" (website).
The connecting "KCY PARTNERS" does not guarantee any transactions conducted by the user with the linked "KCY PARTNERS" that is not managed or controlled by the connecting "KCY PARTNERS".

Article 22 Governing Law and Jurisdiction

These terms and conditions are governed by the laws of the Republic of Korea.
In the event of a dispute arising from the use of the service, it shall be brought to the jurisdiction of the court having jurisdiction over the residence of the user.

Article 23 Dispute Resolution

"KCY PARTNERS" will establish and operate a compensation handling organization to reflect the legitimate opinions or complaints raised by users and to handle compensation for damages.
"KCY PARTNERS" will prioritize handling complaints and opinions submitted by users. However, if prompt processing is difficult, the user will be immediately notified of the reasons and the processing schedule.
If there is a request for damage relief from a user in relation to an e-commerce dispute between "KCY PARTNERS" and the user, the matter may be subject to mediation by the dispute resolution organization commissioned by the Fair Trade Commission or the mayor/governor of a city or province.

Article 24 Jurisdiction and Governing Law

For lawsuits regarding e-commerce disputes between "KCY PARTNERS" and the user, the lawsuit shall be filed with the court having jurisdiction over the user’s address at the time of filing. If the user does not have an address, it shall be filed with the court that has jurisdiction over the user's residence. However, if the user’s address or residence is unclear at the time of filing or if the user resides abroad, the lawsuit will be filed with the competent court according to the Civil Procedure Act.
Korean law will apply to any e-commerce lawsuits filed between "KCY PARTNERS" and the user.

Supplementary Provisions (Effective Date): These terms will take effect on October 21, 2024.
